BUYING PROCESS - INVEST IN TURKEY
When purchasing property or land with Invest In Turkey we will guide you through every step of the buying process, ensuring that from the moment you select the property or land you wish to acquire we are by your side, guiding you with our expert knowledge and experience.
AGREEMENT & DEPOSIT

Following your final decision of which property to purchase, we will make an appointment for you to meet a representative of our recommended European Property Law Firm. At this point the solicitor, with your agreement, will draw up the sales agreement between yourselves and the property owner/developer, this will outline the terms, payment schedule and conditions agreed and ensures maximum protection for both parties involved.

 

The solicitor will complete initial checks on the specified property to ensure that:

The person who is selling the property actually owns itThere are no charges or debts on the propertyFor off plan purchases that the necessary building permissions and licenses are in orderThe terms and conditions stipulated by the seller of your Turkey property are fair and reasonable

 

You will be requested to pay an initial holding deposit to secure your purchase, usually GBP 2,000, at this stage. This is essential due to the fact that prices of properties in Turkey are constantly increasing and the market is very active.

 

Your solicitors fee for dealing with the purchase is payable following your return to your native country.

LEGAL REPRESENTATION

We advise our clients to give Power Of Attorney to their solicitor in Turkey, this enables your solicitor to act on your behalf through all stages of the purchase process including completing the military clearance application, obtaining tax numbers, opening bank accounts in Turkey, completing the  release of title deeds from the title deeds office and finally completing the registration of the utilities into your own name.

 

Please note that giving power of attorney to the solicitor avoids you having to travel to Turkey several times within a matter of several weeks/months whilst your Turkey property purchasing process continues.Please also note that giving a solicitor power of attorney does not give us or the solicitor any claim over your Turkey property, it will be your name on the title deeds.

 

Please note: The choice of solicitor is with yourselves, however, we will make recommendations based on our knowledge and experience.  In order to officially appoint a Turkish solicitor, you will need to give power of attorney during your inspection trip in Turkey.

COMPLETION OF THE PROCESS

Once you have given power of attorney to your appointed solicitor they will firstly arrange for the military clearance application to be made, this is a necessary process for all non Turkish nationals purchasing property in Turkey. The military check is a formality and is only to determine that the area in which your chosen purchase is located is not within a military zone where foreign ownership is forbidden. The process for this takes approximately 3 months.


After the military clearance has been obtained from the relevant authorities and both parties have completed their contractual obligations, the solicitor will then arrange for all the paperwork relating to your property purchase, to be sent to the title deeds office for the transfer of the title deeds of the property into your name.

Please note that all resale properties are subject to a fee of 3% of the purchase value.
